Applicant: An applicant is a person whose request to participate in the Brownfield Cleanup Program has been accepted by the Department of Environmental Conservation.
Brownfield: A brownfield is any real property where redevelopment or re-use may be complicated by the presence or potential presence of a hazardous waste, petroleum, pollutant, or contaminant.
Brownfield Cleanup Program: This program was signed into law in October 2003 by Gov. George Pataki. According to the New York State Department of Environmental Conservation, "The goal of this new program is to enhance private-sector cleanups of brownfields and to reduce development pressure on "greenfields". This new program now provides parties with the predictability and finality they need in order to make cleaning up a contaminated property a sound investment." |

Brownfield Opportunity Area Program: This program "provides technical and financial assistance to municipalities and community-based organizations to conduct redevelopment planning for designated areas containing brownfield sites."
Certificate of Completion: A Certificate of Completion is issued by the NYS Department of Environmental Conservation (DEC) once it is determined that remediation requirements have been achieved or will be achieved under an approved Work Plan.
Citizen Participation Plan: The applicant is required by the DEC to outline steps for public participation. See Fact Sheet.(PDF/7.40KB)
Community-Based Organization: Community-based organizations are defined as not-for-profit corporations that are incorporated under Section 501 (C) (3) of the New York State Internal Revenue Code whose stated mission is to promote the reuse of brownfield sites within a specific geographic area in which the community based organization is located; has 25 percent or more of its Board of Directors residing in the community in such area; and represents a community with a demonstrated financial need. |

DEC: The New York State Department of Environmental Conservation.
DOH: The New York State Department of Health.
Participant: A participant is an applicant who was the owner or operator of the site at the time of disposal of hazardous waste or discharge of petroleum, or who is otherwise responsible for the contamination.
Pre-Application Meeting: The pre-application meeting is an opportunity to meet with DEC staff to "review the benefits, requirements, and procedures for completing a project in the BCP. Holding preapplication meetings helps projects to be completed more quickly and efficiently. Recommended participants include the Applicant, Applicant's consultant and counsel, the Department's Project Manager, Project Supervisor, Project Attorney, and a representative of the NYS Department of Health (DOH)."
Remedy: A remedy is a method for cleaning up contamination on a brownfield site. |

Site Contact List: Anyone interested in staying informed about a particular brownfield project can request to be listed on the Site Contact List for that project. Once listed, you will receive meeting notices, fact sheets and other information regarding the project.
Volunteer: A volunteer is an applicant who is not liable for disposal of hazardous waste or discharge of petroleum at the site, or whose liability arises solely from site ownership acquired after the disposal/discharge of hazardous waste or petroleum provided that the Party has taken reasonable steps to: |

stop any continuing release, |

prevent any threatened future release; and |
 |
 |
 |
prevent or limit human, environmental, or natural resource exposures to any previously released hazardous substance. |

Work Plan: This document explains the technical features of the site investigation, such as the number of soil samples needed, levels of testing performed and quality control measures to be implemented.
